POLICIES AND DISCLAIMERS

1. LIMITATION OF LIABILITY

Although Toronto Image Works takes reasonable precautions against malware, malicious code and viruses, Toronto Image Works and its partners and affiliates assume no responsibility for damages to any computer or system from the use of this website or files downloaded from this website.

2. ON LINE ORDER POLICY

2.1 Changes to Online Orders

We ask that every customer using the online photo ordering service review their order carefully before submitting their order to the lab for processing. Production begins immediately once your order is received at the lab. We are unable to change image size or other output options once we have received your order. Your order will proceed with the options you have selected at checkout.

2.2 Refunds on Online Orders

Only a portion of the payment towards your order is retained by the lab. For this reason, refunds will only be issued in the case of defective materials or workmanship.

3. STORAGE LIMITATIONS

3.1 Use of FTP Services

Access to FTP service is offered free to our clients as a convenient method for transfering files to and from our production facility. It is not intended as permanent file storage and files kept on the server for longer than 30 days are deleted. Toronto Image Works does not accept liability for damage or loss of data stored on the FTP server. Further, Toronto Image Works retains the right to deny any user access to FTP services at any time and for any reason. User accounts may be removed after a period of inactivity or privleges terminated if a user is suspected of uploading malware, virus infected files, illegal materials etc.

3.2 File Retention

Digital files used the in creation of printed works are cataloged and stored at Toronto Image Works as a convenient way for our clients to work on longer term projects and achieve consistent results from our printing services. Any client at any time may opt out of having their digital files stored on Toronto Image Works’ servers. All clients are responsible for their own digital media storage and backup strategy. Toronto Image Works assumes no responsibility, financial or otherwise, for the loss of client data.

4. PROCESSING AND HANDLING

4.1 Mounting and Laminating

Although Toronto Image Works handles all client submitted works with great care, it must be acknowledged that damage to said works may occur during mounting and laminating processes that is beyond the operator’s control.

By submitting original works for mounting or laminating at Toronto Image Works, the client acknowledges that Toronto Image Works shall not be held liable, financially or otherwise, for damages that may occur to the submitted work during the production process.

4.2 Framing and Refits

Although Toronto Image Works handles all client submitted works with great care, it must be acknowledged that damage to said works may occur during the framing process.

By submitting original works for framing or frames for refitting,  the client acknowledges that Toronto Image Works shall not be held liable, financially or otherwise, for damages that may occur to the submitted work during the production process.

4.3 Shipping and Handling

Toronto Image Works shall not be held liable financially or otherwise for items damaged during shipping.

Whenever possible, Toronto Image Works recommends the use of shipping companies that are specialists in art handling for shipping and installation.

5. REFUNDS AND RETURNS

5.1 General Terms

We ask that all clients inspect their order items upon receipt. All Items are non-returnable and non-refundable after 48 hours of receipt.

5.2 Material Flaws

We strive to source top quality materials but occasionally they may contain minor flaws and imperfections. These manufacturing issues are out of our control.

We inspect all materials and refuse any with major issues. Due to the nature of the materials used we cannot redo a piece due to minor imperfections in the material. We have our own tolerance and if the imperfection is minor and not noticeably visible from a standard viewing distance of three feet, we deem it acceptable.

6. COPYRIGHT

6.1 Copyright and Reproduction

Toronto Image Works offers reproduction services for artist’s original works. We will not reproduce images where the request does not come from the original artist. We cannot copy magazine images, books, photographer’s proofs etc. without written permission from the copyright holder.

6.2 Right to Refuse

Toronto Image Works reserves the right to refuse reproducing any work where the copyright status is unclear (as in the case of works that may or may not be deemed public domain).

7. ANTI-DISCRIMINATION

Toronto Image Works is committed to creating a safe and respectful environment for everyone and does not tolerate discrimination, harassment, or violence.
